Gorsuch, Be Gone!

Some of Judge Gorsuch’s past decisions are troubling. He seems to favor the letter of the law over the spirit of the law and has a history of siding with corporate and business interests over labor. Here are a couple of examples …


  • The Case of the Frozen Truck Driver. You can read about it here. His dissent from the (thank goodness) majority decision of the 10th Circuit Court of Appeals reflects an approach that allowed the truck driver absolutely no rational way out of his dilemma. Gorsuch’s view seems to be that the driver should have risked hypothermia or frostbite rather than break a minor rule.
  • The Case of the Special Ed Student. The Supreme Court has just overturned a Gorsuch decision which found that the Individuals with Disabilities Act only requires public schools to provide a merely “more than de minimis” education for students with special needs. The Supreme Court found that this standard is completely inadequate.

Moreover, it would be highly inappropriate at this time for the GOP to use the foolhardy and precedent-breaking “nuclear option” to force through a lifetime appointment when the nominee has been put forward by a President currently under suspicion of colluding with a foreign power.
